Collaborative divorce is an alternative to the traditional litigation based divorce process. In cases where both parties wish to minimize conflict and expense, and are able and willing to work together to reach a fair settlement, the collaborative process can avoid many of the disadvantages of the litigation model.
Collaborative process requires that both parties and their attorneys work together to explore settlement options that maximize options and address the interests of both parties and children if they are involved. In this manner, both parties can enjoy better outcomes, conflict can be minimized and families can avoid much of the tremendous emotional and financial strain involved in the typical divorce. The goal is to achieve the best possible settlement for both spouses and children prior to filing anything in court.
Collaborative divorce is not the most suitable option for everyone. In cases where one party is unwilling to participate in a collaborative process, traditional litigation may be required.
